Terms and Conditions of hire

The hirer must:

a) before towing the trailer and equipment:

(i) provide an unrestricted current Australian driver's license to Ice Maiden;

(ii) be at least 21 years old if picking up the trailer;

(iii) ensure that any vehicle that is to be used to tow the trailer is registered and comprehensively insured;

(iv) ensure that the intended towing vehicle has a 7-pin round socket or suitable adaptor;

(v) allow Ice Maiden to inspect the vehicle to be used to tow the trailer and equipment, and acknowledges that Ice Maiden reserves the right to refuse to provide the trailer and equipment if the hirer's vehicle is, in the opinion of Ice Maiden, unsuitable for the purpose of safely towing the trailer and equipment.

b) during the hire period:

(i) ensure that the trailer and equipment remain under the hirer's direct control and supervision, and are not lent or sub-leased to any other person;

(ii) ensure that the trailer and equipment is towed in a safe manner having regard to the current weather and traffic conditions;

(iii) ensure that no person or persons towing the trailer and equipment is under the influence of alcohol or drugs;

(iv) observe and comply with all laws, by-laws, rules and regulations then in force in relation to the towing, operation, storage and use of the trailer and equipment;

(v) indemnify Ice Maiden against all actions, claims and costs arising from the permitted use and/or negligent use of the trailer and equipment;

(vi) pay all costs associated with the use of the trailer and equipment including the costs of electricity and generator fuel to operate the equipment, and any tolls, traffic infringement notices or parking fees incurred during the period of hire;

(vii) allow Ice Maiden's agents and representatives to inspect and repair the trailer and equipment at all reasonable times during the period of hire;

(viii) ensure that the wheel clamp and/or towbar lock fitted to the trailer and equipment is not removed without the written consent of Ice Maiden;

c) upon the expiration of the hire period:

(i) return the trailer and equipment immediately upon the expiration of the hire period

Payment of booking fee, hire fee and bond

The hirer:

a) must pay the booking fee nominated by Ice Maidens, which is not refundable if the booking is cancelled less than 14 days before of the first day of the period of hire;

b) must pay the hire fee in full on or before the commencement of the period of hire in cash or by EFT to the Ice Maidens Business Bank Account;

c) acknowledges that the trailer and equipment is clean and has been received in good working order at the commencement of the period of hire, and is suitable for its intended purpose;

d) must pay a bond in addition to the hire fee, which will be refunded only once the trailer and equipment are returned in the same condition inside and out as at the commencement of the period of hire;

e) Acknowledges that if the trailer and/or the equipment is returned dirty or damaged in any way, Ice Maidens will, at its complete discretion, retain all the security bond or the part of the security bond required to restore the trailer and equipment to its pre-hire condition.

Permitted use of the Equipment

The hirer must ensure that the equipment is not used for the storage of:

a) illegal or illicit substances, or stolen goods;

b) uncovered fish or fish products;

c) uncovered meat or meat products;

d) Animal corpses or carcasses.

Damage to or loss of the trailer and equipment

The hirer must:

a) ensure that no person or person/s alters, modifies, or tampers with the trailer or the equipment in any way;

b) notify Ice Maiden as soon as possible after the hirer becomes aware of any defect in the trailer or equipment during the period of hire;

c) if the equipment is damaged in any way, allow Ice Maidens access to the trailer and equipment at all reasonable times to make any necessary repairs and to reinstate the trailer and equipment to the condition it was in at the time of delivery to the hirer;

d) indemnify Ice Maiden in respect of all costs of loss or repair to the trailer and equipment and such costs shall be payable on demand by Ice Maiden;

e) notify the police and Ice Maiden immediately if the trailer and equipment is stolen.

Breakdowns/Accidents

The hirer must:

a) advise Ice Maiden and the police as soon as possible in the event of a breakdown or an accident involving the trailer or equipment;

b) obtain the following details from any other driver or person involved in an accident with the trailer and equipment:

(i) name, address, date of birth, and telephone number;

(ii) drivers licence number. A photograph of the other driver's licence is required if possible;

(ii) the registration number, make, model and colour of any other vehicle involved in the accident; and

(iv) the names and addresses of any witnesses to the accident.

c) obtain the names of the police officers to whom the report of the accident or incident is made, and record the time of that report, and any report number issued by the police;

d) indemnify Ice Maiden for all loss or damage incurred by the hirer in the event of a breakdown or an accident involving the trailer or equipment.

Personal items/products stored in the equipment

The Hirer indemnifies Ice Maidens against any claim for loss or damage to any product, materials or personal items stored in the trailer and equipment by the Hirer.

Fee for late returns

The hirer must:

a) pay a late fee calculated at the current rental rate if the trailer and equipment is not returned by the due time and date;

b) request hire of the trailer and equipment for additional days as soon as possible during the period of hire and return the trailer and, if any extended period of hire is agreed upon by the hirer and Ice Maiden, return the trailer and equipment promptly by the new agreed time and date;

c) pay all costs incurred by Ice Maiden in recovering the trailer and equipment that is not returned by the hirer at the agreed time.

Termination of the hire agreement

Ice Maidens may cancel the Hire Agreement at any time if these Terms and Conditions of hire are contravened.

Acknowledgment

The hirer acknowledges that, if the Hire Agreement is breached by the hirer, Ice Maiden may retain the some or all of the bond paid by the hirer as compensation for any loss or damage incurred by Ice Maiden as a result of the breach of this Agreement by the hirer, and acknowledges that Ice Maiden may also seek further compensation from the hirer for any loss or damage sustained by Ice Maiden as a result of the hirer's breach.
